Biography
Mr. Carey is an accomplished dispute resolution expert with an emphasis on securities arbitration. He has been an Associate Director and Manager for over three decades at the New York Stock Exchange (NYSE) and the Financial Industry Regulatory Authority (FINRA). Mr. Carey's practice and expertise areas includes arbitration, bankruptcy stays, bifurcating claims, employment discrimination procedures, injunctive cases, subpoenas, expungement, orders vacating awards, venue, award offsets, settlements and assignments, privacy, Suspicious Activity Reports and FINRA expedited suspension proceedings. Mr. Carey has attended over 300 hearings as arbitration counsel for the NYSE. Mr. Carey has trained and counseled arbitrators on discovery, hearing procedures and award preparation in cases involving wrongful termination, defamation, whistle-blower claims and bonus disputes. He has extensive experience with Securities and Exchange Commission (SEC) filings and SEC document requests and inspections.
Mr. Carey’s substantive legal experience includes a civil defense litigation practice in automobile cases including depositions, motions, pleadings, New York no-fault law and appeals. He is also experienced in residential real estate, landlord and tenant, auto leasing, property tax assessment challenges, valuation of community banks and securities valuation. Mr. Carey has appeared at a panelist for the American Law Institute, Practicing Law Institute and New York State Bar Association. Mr. Carey’s publications include Discovery Abuses Can be Costly, The Neutral Corner (2019); Board of Editors, The Neutral Corner; Update on Securities Litigation Issues, The New York Law Journal (2001); A Mutual Holding Company Can Repurchase Stock By Establishing a Stock Holding Company, New York Business Law Journal (1999); A Broker’s Disclosure of Payments for Money Market Sweeps: The Second Circuit Defers to the SEC, Journal of Investment Compliance (2001). Mr. Carey received his J.D. from St. John's University School of Law and is a graduate of Cornell University’s School of Industrial and Labor Relations. He currently serves on the Advisory Committee of the New York Law School ADR Skills Program.
