Biography

Joe DiBenedetto spent 46 years practicing commercial litigation as a Capital Partner at Winston & Strawn LLP, and its predecessor firm, Cole & Deitz, in New York City. Winston is an international law firm with over 1000 lawyers in 18 offices throughout the United States, Asia and Europe. Five years ago, he formed JDB Mediation LLC, whose mission is to assist litigants in arriving at a settlement quickly and effectively through a mediation process that will make them comfortable that settling on fairly negotiated terms is their best option. Mr. DiBenedetto has extensive experience with all types of commercial matters, including bank litigation, UCC cases, class actions, shareholder disputes, acquisitions, business torts, securities laws, professional liability, environmental litigation, contract disputes, ERISA, FLSA, FCRA, consumer protection, construction, real estate and foreclosure, insurance, and product liability. Mr. DiBenedetto has had over 50 hours of commercial mediation training, and has been a member of the Panel of Neutrals for the Commercial Division, New York County ADR Program since its inception in 1996. 

 

Mr. DiBenedetto also serves on the Panel of Neutrals for the United States District Court in the Southern and Eastern Districts of New York, and the Commercial Division ADR Panels in Nassau, Suffolk, Queens, and Westchester Counties. He was recently appointed to the EDNY ADR Advisory Council for a two-year term. Mr. DiBenedetto also acts as an arbitrator, and is on the Panels of Arbitrators maintained by FINRA, the National Futures Association, Forum, and the New York State Supreme Court, N.Y. County Part 137 Fee Dispute Resolution Program. He has written extensively on ADR topics, and is the author of the NYS Bar Association Deskbook on Arbitration. He has completed over 250 ADR cases as a neutral and participated as a litigant in more than fifty (50) mediations and arbitrations while in private practice. He has handled cases that were high profile and drew media attention, and others that were routine commercial disputes. Mr. DiBenedetto received his J.D. from St. John’s University School of Law in 1970, where he was Managing Editor of the St. John’s Law Review and ranked 2nd in a class of 287. He received his B.A. (with honors) from St. John’s University in 1967.
